Loose horse lawsuit

Scenario: A woman slams into a horse with her car on a country road. The horse is knocked to the ground and must go on pain medication. Guess who files a lawsuit?
If you guessed it was the horse’s owner, you were dead wrong. In the surreal world of civil litigation, it’s the driver in this case who’s suing the horse’s owner and keeper for personal injuries.
In a lawsuit filed Oct. 30 in Multnomah County Circuit Court, 27-year-old Jennifer Famulare of Gresham claims she suffered injuries to her back, neck and hip as a result of her collision with a stray horse in 2005.
Famulare’s attorney, Timothy Vanagas, tells WWire his client was driving at dusk on Southeast 302nd Street in Gresham when she ran into a horse that had escaped from a nearby stable.
Famulare was pregnant at the time, Vanagas says, and was worried about her baby as a result of the accident. The boy was born with high-blood pressure exacerbated by the crash, and delivery had to be induced, Vanagas says.
The lawsuit was filed against Patricia Boast, the horse’s owner, and Patricia Carson, who owned the stable. The suit claims Famulare’s injuries were “the foreseeable result of the defendants’ negligence” in allowing the horse to escape. The suit seeks $4,750 for Famulare’s medical bills and $40,000 for pain and suffering.
Boast and Carson could not be reached for comment.
